DMCA Notice & Takedown Policy

All My Flix, LLC operates bbcadventures.com ("BBC Adventures") and qualifies as a "Service Provider" as defined by 17 U.S.C. § 512(k)(1) under the Digital Millennium Copyright Act ("DMCA"). This status affords us certain protections from copyright infringement claims under the DMCA's "safe harbor" provisions. We respect the intellectual property rights of others and expect our users to do the same. Therefore, we adhere to the DMCA and have implemented the following Notice and Takedown Policy for claims of copyright infringement by our users.

Submitting a Notice of Claimed Infringement

If you believe that your copyrighted work has been copied and made available on BBC Adventures in a way that constitutes copyright infringement, please provide our Designated Agent (details below) with the following information:

  1. An electronic or physical signature of the person authorized to act on behalf of the copyright owner;
  2. A description of the copyrighted work that you claim has been infringed;
  3. A description of where the infringing material is located on BBC Adventures (preferably including specific URLs);
  4. Your address, telephone number, and email address;
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Please note that our Designated Agent is only authorized to receive DMCA Notices and not any other inquiries. Any agency relationship beyond accepting valid DMCA Notices is expressly disclaimed unless prior express permission is given.

Abuse Notification

Misusing the DMCA Notice procedures or providing false information in a DMCA Notice or counter-notification can result in legal liability for damages, court costs, and attorneys' fees under federal law. See 17 U.S.C. § 512(f). These Notice and Takedown Procedures only apply to claims of copyright infringement by copyright holders and their agents - not to other kinds of abuse, infringement, or legal claims. We will investigate and take action against anyone abusing the DMCA procedures. Ensure that you meet all legal qualifications before submitting a DMCA Notice to our Designated Agent.

Responding to Takedown Notices

Upon receiving a valid notification of claimed copyright infringement, BBC Adventures will promptly disable access to or remove the infringing material. We have a policy to terminate the accounts of repeat infringers when appropriate. If a Notice does not fully comply with § 512 of the DMCA but meets three notification elements, BBC Adventures will attempt to contact the complaining party to assist in compliance. Once a valid Notice is received, BBC Adventures will expeditiously remove or disable access to the infringing material and notify the affected user. The affected user can submit a counter-notification to the Designated Agent if they believe the removal was due to a mistake or misidentification. After receiving the counter-notification, BBC Adventures will replace the material within ten to fourteen (10-14) business days unless the Designated Agent receives notice of court action by the complaining party.

Submitting a Counter-Notification

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification. Please provide our Designated Agent with:

  1. A description of the material that was removed or disabled;
  2. A description of where the material was located on BBC Adventures before removal (preferably including specific URLs);
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled due to a mistake or misidentification;
  4. Your physical address, telephone number, and email address;
  5. A statement that you consent to the jurisdiction of the federal district court where you are located, or any judicial district where the service provider may be found if you are outside the U.S., and that you will accept service of process from the person who provided the Notice.

Please do not send other inquiries to our Designated Agent. Only DMCA counter-notifications will be accepted.

After receiving a counter-notification, our Designated Agent will forward it to BBC Adventures, which will provide it to the claimant. Within ten to fourteen (10-14) business days of receiving a counter-notification, BBC Adventures will replace or restore access to the disputed material unless the original claimant has initiated a court action to restrain the allegedly infringing activity.

Language and Modifications

All DMCA notices and counter-notifications must be written in English. Notifications in other languages will be deemed non-compliant and ignored. BBC Adventures reserves the right to modify, alter, or update this policy. Affected persons should regularly check for changes.
